View Full Version : Bought a new O2 XDA Exec. And I what did I get?

I bought a brand new O2 XDA exec on ebay. This guys sells a ton of them, and has 100% positive feedback. I got it today (3 days past the garranteed delivery date) and I looked at the call duration. It has over 12 hours of outgoing calls, and over an hour of incomming calls. Now, this guy lives in Hong Kong, and I don't want to ship this thing all they way back to him. Also, I have to press VERY hard to get the spacebar to work. Is that normal?

What do you guys think I should do? Aside from the spacebar it works fine. But I payed for a new one...

Ask him why it's not new and see what he says. Maybe he shipped the wrong one? Then play it by ear, might be a genuine mistake...

If it is having a outgoing and incoming call duration time then its definately not a brand new piece it is a second hand & hey y to settle for a second hand if u have oaid the price for a new one .

and it is alrite n does not have the problem u got

I've looked the device over more today, and the paint is chipping off one of the hinges. He said I could ship it back to him and get another "New" device but that will cost me alot to ship back to hong kong, and I'm sure I'd get another used device.

I have been reading through XDA forums for a year now on the Universal threads. I had never encountered anything about upgrading ROMs through an SD Card. PLUS, anyone who had upgraded their device knows that the CALL TIMERS are UNAFFECTED by a ROM upgrade. The solution for setting the CALL TIMERS back to zero was just posted about a month ago. So if I were you, I would return the device and opt for a full refund. Report the seller for misrepresentation of an item and have him banned at ebay.

So he lied to me twice? Would it be easier to just deal with this through ebay, instead of the seller himself? Does everyone else think the same?

I've had negative experince with ebay / paypal when electronics are shipped as new, my experince was that after a couple weeks, paypay decided that the value of the item was not affected by it being used. So I submitted a claim with ebay, ebay required that I get the item appraised by someone in the industry, on company letterhead, with that companies information, contact information... and what they belived the value was. Ebay would then pay the difference.

I just said screw it, becuase what was I supposed to do take it into Best Buy or Radio Shack, and ask them to do it?

I've bought a lot of stuff on ebay, and the ONLY bad experiences I have had were on items from Hong Kong. I NEVER buy anything from there now. It is not in my nature to issue generalized prejudices, but really, out of about seventy deals, the only three bad ones were from there, and I only bought four Hong Kong items..... One item didn't work, but it was dirt cheap so I just shrugged it off, one was cheap and an absolute counterfeit unfit for purpose, and the other was not as described by way of condition. NEVER AGAIN for me.

Windowsrookie, I suggest you contact the seller first to see if he could do a full refund.
Otherwise if he doesn't accept, contact ebay and explain the situation.

I personally think sellers like this one should be banned from ebay.

Here's what I think you should do:
Search the EBAY for info about items that are very different from the advertised. Yours is used, and that's a lot different from a new one. File a complaint, following all the right procedures.
At the same time, file a complaint and ask for refund from PayPal (assuming you paid via PayPal).
There were a lot of complaints about fake ULTRA II SD cards, and EBay itself published an article on how to proceed.
If all goes well, you'll got to keep the unit you recived AND get your money back - meaning you'll get yourself a free O2 phone.

None of this is illegal: those are the recommended procedures EBAY suggest you to take.

Also, I just noticed. The D-Pad on my O2 is sliver. Isn't it supposed to be black?

YES, the D-Pad shoud be black. I have an O2 Exec and ALL is black except for the slightly silver metal top.

Talk to him and demand a FULL refund, but don't cancel the ebay report until you get your money back. Demand that he should reimburse you for the shipping and handling.

It is a fraud indeed, if the one you got is all silver in color, it is call T-Mobile, if it is all grey in color, it is call Dopod 900, if it is all black, it is O2 exec.

In fact, Hong Kong has no T-Mobile and O2 exec for sale, it has only parallel import from UK or Europe. In Hong Kong, officially only Dopod 900.

Back to your case, I was advised that you can actually report to Hong Kong Police through the internet. Don't let him get away.

As you can see, the paint is chipped on the edge, and the D-Pad is sliver. How could they mix up the D-Pad?

It came in a DoPod box, but is O2 branded...

ARE YOU CRAZY?? Dont ship the damn thing back!

Take as many photos as you can.. Get him to send you a NEW ONE by DHL, and to collect the old one with it.

For gawds sake,dont let him get his hands on that one before you have a 100% Working and NEW product!

Tell Ebay that he wants the product back from them, but you think that it is a fake product, and you dont trust him to replace the device anymore....

Does the IMEI match the one on the label??



EDIT:: Actually digging up a bit about this guy.. He has got 100% positive... however... he has 15 Withdrawn comments within the last 2 Months, and another 6 that say the phone has hours on it!

Dude.. READ THE comments on stuff like this BEFORE you buy! LOL

SO.. Ask for a replacement device AT HIS expense... sent now..

if he doesnt.. Red mark the dude..

He's the one in the wrong, so make him pay what he says he will before you do anything.

Also, DON'T CANCEL OR SUSPEND THE PAYPAL CLAIM until you got exactly what you paid for with no extra expense to you - it CAN NOT be restarted or resumed.

Finally, I'd keep all communication within the Resolution Centre - the PayPal people can easily access that and it keeps records for evidence.

Mine DID, however, come in a Dopod box like yours, with no manual and no case. I went through another person on another auction that was in SouthCarolina, but the item shipped from China. I was very skeptical after I got the package. Lid was loose. Working on a refund now and will file a complaint if I don't get it.

Now, this guy seemed to be VERY concerned with making things right, so I wouldn't take any BS and follow your gut. Maybe see if you can squeeze extra accessories BUT DON'T PAY FOR ANY SHIPPING. He should pay the shipping for going back, and for the new one going to you. Don't ship your device back until you get a refund.

Well, I sent him another email asking that he send me a new one first. I don't know if he'll go for it since I only have two feedbacks on ebay. But we'll see.

Where is the EMI locketed in the OS and on the phone? I doubt it's the same, considering the D-Pad is from a silver Universal.

YES! my screen was loose too! The screw holding it together just fell right out a few days ago. and now it's stripped.....

And he offere dto ship my every accessory ever made for this thing to me for my trouble. Yet, he never offered to ship me the new phone first....

That is a total lie! I live in Hong Kong as well, and O2 here DOESN'T carry this model!! I had to get my Exec from UK!!!! Besides, the air-time will NOT get copied over even if they did what they said they did to the phone.... Report to eBay, and if you paid with PayPal, you should be protected...

This is clearly a refurbish ppc, the seller might got a lot of returned ppc or second hand ppc (either official goods or parallet import) and refurbish them and sell them at low price.

So, the one you get may have a O2exec body, Imate netivagtion or keypad, and Dopod mother board etc. I suggest you check on the IMEI no. to see whether it matches with the box.

It's great that I came across this thread, just a few days ago I almost purchased three units of O2 XDA Exec from the same supplier. Although, unlike you I don't have a Paypal account, so I e-mailed the supplier if he could instead deliver the item to my office in Hong Kong and pick up the payment on an agreed date. But being the cautious trader that I am, I made sure to do some research before pushing with the transaction. And guess what! I found out that the office address on their e-mail doesn't even belong to them but to another company and when I confronted them about this they told me that they have recently moved to another office during the Chinese New Year, Yeah Right! As if I'll buy that crap! They even gave me their new address which is in Causeway Bay so I bluffed them that I'll visit their new office which is just two blocks away from my North Point office but they chickened out saying that they don't welcome walk-in clients and that that office is only a service outlet for product returns. They even told me that they only sell to eBay clients from the U.SA, U.K and Canada with verified Paypal accounts when they have already agreed to deliver the items to me. Web of lies! What a crap! I knew this offer was too good to be true from the start!

Report this to eBay! As I'll be filing a report as well!

I just spoke with the supplier and threatened them of closing their business. Here's what I wrote last night.

Never mind the order! I have finally made up my mind to file a complaint with Ebay.com.hk regarding your illegal operation! Coz I’ve just read on one forum that you have supplied a defective refurbished O2 XDA Exec unit which you claimed to be new to one client of yours. I have already spoke to the said client and informed him that you almost scammed me by giving me a fake company address and even giving me an excuse that you have just recently moved to a new office in Causeway Bay. But when I asked you if I could instead go to your office in Causeway Bay to purchase the item there directly your company chickened out saying that it’s only a service outlet for returned items! What kind of crap is this anyway? I have never heard of a company not wanting to deal with their clients personally and how come you can afford to have a service outlet and not a sales office? One lie after another! Then when you can’t think of any believable excuse to say you replied by saying that your company only transacts with eBay clients from the USA, Canada & UK with verified Paypal accounts when it the first palce you have already agreed to deliver the items to my office and pick up the payment here. The problem all started when I learned about your fake address through my office staff and when I asked to inspect the item before paying it! Now I know why, because you are afraid that I found out the truth about your company’s fake identity! And most of all, you are afraid that if I inspect the item I will learn that it is not brand new! Now it’s too late! As I have decided to coordinate with the Hong Kong police with this matter as well and they asked me to print them a copy of our e-mail conversation. Too bad, say goodbye to those 365 good reviews! It’s now down the drain!

I’ll go to your office in Causeway Bay on Friday if it does exist together with a Hong Kong Police officer to check your company! By the way, I’ll be sending a copy of this e-mail to ebay as well.

that looks like to me that it is a Jasjar that has been recased. except for the pad...

which I believe to change that you have to do some reconnecting of wires etc. but the rest you can buy blank cases and change the entire unit.

Looks to me like you got a bad deal here

Well, he sent me another "New" one. This one has 20 minutes of call time on it. I'm just going to keep it. But the dispute is still going in PayPal, so their account is restricted. It's been this way for a while and I haven't heard from them....

They blamed the old one on their "supplier", whatever. I never got my free windsheild mount.

Unfortunately, I discovered this thread only yesterday, so I was expecting troubles when the device arrives and here we go:

the device arrived today. It looks ALMOST as new, but definitely it is NOT new as the device is slightly worn on a couple of places. I may provide photos if you care.

I have written an inquiry to cellularhk asking him to send me a new device as advertised.

I'm PUZZLED that this eBayer is still around and happily advertising new scams at eBay!! If he doesn't resolve my issue, I will go for the PayPal protection. The item was protected up to $2000 as they said on eBay. So we'll see.

I'll keep you updated on this.
