ok... i am surprised i have not heard anything about apple using the name "touch" for this device, since HTC already has a device called "touch".
oh yeah - all my co-workers who bought iphones are pissed at the price drop! $100 per month loss! i wonder if it was worth it? HAHAHA:D

Well, this is where things get a little tricky. First, the HTC Touch is named "HTC Touch" (or it's named something else by a carrier, I don't know much about the HTC Touch). the iPod Touch is named "iPod Touch." "HTC Touch" ≠ "iPod Touch." It's the preceding word that might get Apple off the hook on the naming.

$100/mo has nothing to do with the base cost of the device, that's the carrier. Besides, Jobs is refunding $100 to iPhone owners, and in many cases, American Express is refunding $200 to people who bought the iPhone through them. I think Visa has a similar policy, but I've only heard about AmEx. Besides, people who bought the iPhone didn't buy it as a smartphone, they bought it for different reasons.
