Turns out that they're saying its not a driver... but a software fix...

In the end, that may be the practical solution.
Drivers aren't especially easy to make, but if they're identifying a stack issue as a major cause of slowness anyway, it certainly doesn't hurt.
Let's hope they're not just screwing with us with this.

Isn't a driver a software fix by defiinition?

Isn't a driver a software fix by defiinition?
In the sense that it is software, sure.
In practicality, not really. Drivers are instructions for how the software can talk to the hardware, and as such, contain a lot of details about how the hardware works, and port mappings, etc. Just considerably more tedious that traditional software fixes.

Engadget might refer to Peter Chou's "official" message, though we all know that ther is still a slight chance the mail is a hoax or at least manipulated.
(99.9 % authentic is claimed)
If it would be true, (the mail was sent to one of the XDA members originally) than a press release from HTC should or would have occured.
No company let the CEO spread a message and then not posting an official statement afterwards.
Neither received HTCclassaction.org any reply(yet) on their mail towards Chou.

Hello,
I work with drivers everyday since I am in the embedded systems design. Its not clear to me how HTC proclaimed stack can cause such a big problem in Video playback. I am sure that they are trying to hide there incompetency in solving this 3D and video playback. But I hope I am wrong and we get a fix soon.

Really skeptical about this, with all that has passed, we all should just wait and see what happens, and now jump the gun, that just leaves place for more frustrations
