I am interested in selling my WM 6.1 upgraded Tilt on EBay, but I don't believe the official ATT WM 6.1 upgrade has come out. Is it OK to do this? I figure its not a big deal since the official ATT upgrade is coming soon and is free for all. Any help would be appreciated. Thanks...

i'm not an attorney, so this is only a guess... you have stretched the EULA for the o/s so thin Intel wants to hire you to design the dies for their next processor

The person buying the phone will get a phone that has no warranty. Yes they maybe releasing an update but it is not the update on the phone. Flashing to factory is quick in easy. Even though the phone may not be under a factory warranty if they developed any issue AT&T will more than likely not help them.

If you live in the US of A, it would be illegal (1999 Digital Millennium Copyright Act). More specifically because HardSPL bypasses copyright protection (in this case the OE's mechanism for controlling where the software goes). Even though the update is free, in this case the illegal part is bypassing it. Since the code is not released, that could also be a problem, but I am not familiar with that.
There is an untested exception to this rule, that indicates you can make archival copies of copyrighted material. But even then you can not bypass any mechanisms to do so. Thats why you can make archival copies of CDs and not DVDs under the DMCA. CDs have no built in protection, DVDs have CSS.
Now you are allowed to carrier unlock a phone. So I guess you could say the hardSPL is a requirement of that. But it might not go over, because you can do this by other means that maintain the branding mechanism.
Now whether anyone gives a shit is a completely different story.
