Ok, so I know basically what a cooked rom is, but I'm trying to find out if making/using one is actually legal. Are you taking a windows mobile rom and modding it with new optimizations? Is it just a layer on top of WM? What exactley are you doing to make one?

You take your phone, a kettle with 2.5 liter water, some garlic (against bad omen), salt etc... Put it on a fire and let it shimmer for about an hour.

Maybe you'd read some FAQ. It's discussed over and over again. Cooking is not legal. Cooking replaces the original OS with a 'better' one....

of course, the cookers (AKA tweakers) just modify the original ROMs, just like modified versions of nvidia drivers.
don't you know how hard it is to developing ROMs?
most of cooked ROMs are buggy & risky.
i don't trust those kiddie-kookie ROMs.
