Love my n5 but I'd wait for the one plus one if I were you. Same price but better hardware.

Where are you buying it from? Anyone can factory reset a phone and you won't be able to tell if it's new by that. If you buy it from the play store it will be new. Also, I was very happy with their warranty/customer service in the past.

Who knows when that will be commercially available. In addition to my first point, no one even knows how their customer service will be or RMA process.
