I was thinking this same thing. I wonder if any of them had pre-orders. haha.

Yeah I've posted bout anonymous in a few other sites too. I'd be giggidy for way to long if apon hearing they were the victims of a cyber attack. I'd take time off work for that just to go to the local bar and buy everyone celebration drinks.

I mean, heck. If I were company A who invented idea X and company B came along with idea X, I would not be so different from Apple.

And, Apple employees are not the ones hording our EVOs. Its the government.

As would I. But in this case, company B invented idea X, company A took the idea and them proceeded to patent it, and then company B is no longer allowed to use idea X.

Maybe the patent system is broken, but that's not Apple's fault. I can think the tax code is unfair and broken, but you better believe I'm going to use every legal loophole and deduction I can to minimize my tax burden. A for profit company has a responsibility to its shareholders.

We have free market capitalism here in the US. Companies are in the business to make money, that's all. If they created or own a legal patent, they have a fiduciary duty to protect their intellectual property. To do otherwise, would be a disservice to their shareholders.

Now there may be other considerations beyond pure money making--contributing to society (philanthropy), for example. Also, Apple could reason that enforcing patent X could lead to some sort of consumer backlash, which, long term, could hurt their profits, though I'm not sure Android/XDA fans are their core constituency.

Could you imagine the Apple board meeting:

CEO: So we created or own the patent to X. I noticed one of our primary competitors is using this technology and haven't licensed it.

Lawyer: I recommend we don't protect our intellectual property because it'll piss off Android O/S (competitor) users who want the new HTC (competitor) flagship phone.

Lawyer 2: We're pretty sure if we let this one go, HTC will look the other way when the shoe is on the other foot.

CEO: Makes sense to me. High five!


Before I'm flamed, I don't like it. But I don't blame Apple. Blame the patent laws and the decision making process. Even more so, blame HTC and Sprint for somehow not anticipating this. When did this decision come down? How did Sprint and HTC get caught with their pants down on this?

First, prove that. Second, assuming you are correct, whose fault is that? Company B. If you are a for profit corporation and you don't understand intellectual property, then you shouldn't be in business.

Apple, in it's victory over HTC for its "patent" has two recourses available:
1.) levy a licensing fee
2.) bar the sale

Which action is taken is solely the choice of Apple.
It choose to be anti-competitive.

Keep in mind, there may not be any infringement of the applicable patents. HTC may have worked around the problem already. The problem is that now another government agency (Dept of Homeland Security) has become involved in the area - and now we're relying on the patent and technological knowledge of workers in the DHS.

Yes, the patent system is broken.
Apple is nonetheless has taken upon themselves to determine what phone I may buy. That is not a power that I have granted to them for me - and it's time that consumers get their say in this stupid farce.

I can't prove it, it was my interpretation of the situation as I know it.

Anyway, I don't think you can blame Google for not patenting every single UI feature in existence. It is ridiculous that multiple companies can't have similar features such as this now-controversial "data tapping" thing. It's a basic, fundamental element of a smartphone's UI. Can someone patent lockscreens, boot animation, cube transitions, and displaying the time and battery life on the status bar? It's going too far.

Look its a sad day for all fans of the evo, But i want my Evo lte. Its not going to happen this week. But We all should not be mad at Apple just bc they own the tech.

We shoud be mad at Htc they new what was out there and if they did not then i am sorry they are no better then Apple with what and how they act.

You can be mad but if it was not a date in the way then it could be next month before we get our evo's.

Yes, they knew about it. Which is why they fixed it, according to people who have used Sense 4.

So, the first person that invented the chair... should everyone who makes a chair after that have to either A) pay a royalty, B) not make chairs, C) make different types of chairs and risk being sued by the first person that made the chair?

I'm just upset they waited so close to the release date to ship it to the US. I thought they normally send stuff at least a week or two in advance in case of shipping issues. :-(

Unfortunately, you are not Apple's customer. You did not buy any Apple product, and you did not bring a company a single cent. Does any of you honestly think that you are telling Apple anything they don't know?

As much as I hate Apple, their tactics, policies and politics, I honestly think that this email flood will generate nothing but few smiles for their execs. Think of it this way. HTC comes up with a KILLER feature that beats all iPhones out there. and iPhonies start coming here and complain about it. I, for one, would be happy. This is the same for their side.

It is in the US, apparently in a warehouse in Kentucky. There is an area of the warehouse which includes international shipments / customs. I assume thats where they were being held.

Except that Apple did not invent the concept for which our Evos are being held. Even dumbphones released before the iPhone were capable of doing this.

1. Apple is protecting something they did NOT invent.
2. HTC DID circumvent the issue
3. Sprint has nothing to do with the legalities between HTC and Apple and as such cannot be blamed for anything.

You're absolutely right. Because people that ordered LTEvos couldn't possibly own any Apple products. People who ordered LTEvos couldn't possibly see the **** that is going on with Apple through this and decide to no longer purchase iPads and Macbooks for themselves and/or their kids. You do realize that Apple does more than just make iPhones.....right? That's some excellent logic you brought to the table.

By the way, the drop down notification bar present in the newer iOS updates.....where did Apple get that from? :eek:

    I don't know if anyone has seen the new post made on portal but I intend to send this to all the Apple Exec's and relevant people I can find.

    We should all send this to the same people to let them know what we think.

    Your ENTIRE organization lacks morals and free market competition basics, and as such, you are not worthy of having the glory that you now posses. While you may have revolutionized the world as we know it with very well crafted marketing campaigns and some good ideas, you are far from being a true innovator in the field of… anything. Just think for one second about the LEAPS in technology that you would have accomplished, should you have invested in R&D a quarter of the money you spend into advertising and marketing. Then, you would have something worth portraying as a technological wonder, something that would likely be untouchable by others. Something truly genuine that you can call your own, and at the end of the day you could look at with pride. What you have right now is a bunch of reinvented wheels, most of which don’t do much more than other wheels out there.

    Redefining concepts and ideas is not what makes a company great; coming up with new concepts is. All the newer models of virtually every product you sell have been remakes of previous technology—perhaps a little thinner and a little faster, but all in all, minor changes.

    It is because of companies like yours that technology is not further today than where it currently is. You are so adamant in protecting something that you didn’t even invent that you are holding back future innovation. This can be compared to using a Linux kernel (if it weren’t under GPL license), patenting it, and closing it off so that no one else can use it.

    Apple, you are simply a disgrace to the world of technology and to engineering in general. I feel ashamed of being called an engineer in a world where your company roams around freely without even following the most basic of the field’s concepts—a world where the law and justice are blind to the fact that your actions are hindering humanity’s advancement. While I understand that there is nothing wrong with making money, there is something very wrong with replacing engineering with greed.

    The amount of Apple fanboys on this forum is disgusting. Anyone who can't see that Apple is trying to create a monopoly is a blind isheep. They found one sympathetic court. They did not find this ruling universally. Just in one court.
