Sure you can.
I actually bought my son a Evo 4G that was blacklisted as lost/stolen. Since it could no longer be activated on sprint's network, it was relatively cheap. It has a nice fast processor, a good amount of memory, a big screen and even a kick stand for watching movies. Way cooler than an ipod touch. Just make sure you put it in airplane mode, than turn wifi on, to conserve battery.

Nice lesson for your son there Dad. Fencing stolen goods on the cheap. Stay classy.

Well, you could get a Kindle Fire and root it, getting cyanogenmod 9 and get ICS on it, it would be a lot cheaper. The GNex is a pentaband phone so you will be able to use almost any GSM network, so you may want to consider getting a prepaid plan (I would recommend T-Mobile's $30/month 5Gbs Data, Unlimited txting, and 100 mins talk). Don't get me wrong, the GNex is one of the best, if not, Android smartphones out there but if you don't actually use the phone part, it's like the ice cream without the sprinkles (I know, I made a terrible example).

By the way, an new unlocked GNex can cost anywhere from $460 and up.
