How can I remove the Black Market theme?

I installed the Black Market theme a few months ago, but yesterday I had to reflash my Droid X to its original state. After I reactivate the phone and get to the home screen, there is only the regular market. So, I click the market, agree to the user agreement, then continue to download apps. But then, the next time i go to the market, it's the black market theme, and I have to answer the agreement again. It goes back and forth continuously between the original theme and the black market theme, and I have to answer the user agreement every time.

Because of this, I reflashed my phone using RSD about 6 times right now, and its driving me insane because it still hasnt been fixed. Please help!!!!!!!!!!

I would go into applications, find the market app, clear cache and clear data, if doesn't auto FC, select to FC. Then uninstall app. Reboot, just to be safe. Once back install the market, here's a link to version 3.1.3:
