EDIT : I'm looking at CM9 treads, and there is the same kind of problem for camera, so maybe is it an AOSP bug.
I don't know if this will work but what kernel are you using maybe try the other kernel because I use my camera daily because it's part of my business to log what condition computers and phones come in before I work on them
