And mad people bricked their phones. Hence later builds do not.

On HTC phones, the kernel and recovery partitions are separate, but on Samsung phones they are not so the recovery is tied to the kernel. All the ics we've been enjoying have been based on some icky mods to the leaked kernels. When people were using recoveries with them, mad people ended up with bricks, myself included.

No recovery until official kernel source. Its not something that's broken, just something we don't have YET

Epic. I just flashed alpha 4 this morning and I should break 3 hours of screen time on my first charge. Hopefully I'll get 4+ by the end of the week!

OK odd thing: I been running this for a week+ now, and I decided to use mobile Odin to flash el26 so I could go back to fe10 modem since fe16 sucked for GPS. I flashed the aosp fe16 kernel when done, then on reboot I don't have root access now? I checked settings/dev options and there were no options for root there. Could it be due to using the AOSP kernel instead of the specific CM9 kernel? Guess maybe I got too used to having AOKP for so long . . . .

If you flash the AOSP kernel instead of the cm9 specific kernel you will lose root. It happened to me a couple times.

Well from the info given by Ken Sumrall the problem being with the eMMC firmware even once we have kernel source if Samsung has yet to do a work around with the kernel we will still have to do one.

With that issue out of place it never was the recovery repacks at fault, even bone stock ics recovery can brick running an update.zip. Good thing there are not any that are meant to be used. But factory resetting still same problem same risk.

this is correct.. you need the fe16 kernel repacked for cm9 or you risk losing root. im sure theres a link floating around.. if not can always reflash rom and gapps to get the kernel back
