This may be the case with att but I dont think it is the case with tmobile (unless the chat rep i talked to 2 months ago was incorrect, which is entirely possible). I was looking to buy a phone off craigslist and adding a line, they told me they wouldnt force data on the line. Just my 2 cents, YMMV

What i plan on doing is selling my Amaze (it's mint, i should be able to make about 300 or so on it), adding a line to my account for the gs3, getting the subsidized price, and cancelling the line for 200. If the cost of the phone subsidized is 199, then i should be able to get out spending about 150-200 as i dont have to pay for activation fees.
