Erm.. yeah Ofcom/Ombudsman Communication regulate mobile networks... they've got the power to give them the kick up the **** they need. As the other user says, at the very least we'd have the satisfaction of making sure they know how angry we are.
Might be worth pointing out in whatever letter you put together that we paid a premium price to have a flagship device. If 3 are unable/unwilling to provide us with even standard updates let alone a premium service maybe they should offer to unbrand the handset for those who ask for it so that they can let HTC take care of it instead.
Seems a reasonable proposition, considering most people who buy a handset would only ever upgrade software if it came up in big flashing lights asking them to, so it would hardly have a noticeable effect on whatever they get from the branding deal they have going considering we are the 1 or 2% of people who buy this phone who would want this.
Anyway, back on subject i contacted three and found out that they're regulated by Ofcom and use Ombudsman for alternative dispute resolution.
I think i'm going to give them the benefit of the doubt until the 10th-20th of august then i'm thinking of taking action further with filing a few complaints to both ombudsman communications and Ofcom for a few matters at hand.
I'm going to challenge three and i hope you guys are behind me

To be honest, I've been thinking of going down a similar route as you smidgeox, but in my case I'm contemplating calling Three and getting them to cancel my contract and I return my phone, in the agreement that my number will be used for a new contract with someone like Carphone Warehouse or similar where I take out a new contract for the HOX on Three.
I've had to constantly swap the phone in and out of airplane mode to get a connection, and I can spend around 3 - 4 hours a day driving. There has been a few times where I've been needing to make a call and had to try to do this (i'm using bluetooth handsfree, but of course you still got to toogle airplane mode) to get a signal and I'm putting myself at risk of an accident or fine. I love the network, I love the speed of it, and am alright with the weird reception issues "put your right foot in you get signal, take your right foot out loose signal," but just would like my phone to be unbranded and updated by the OEM.
Well either the above or give me a frigging job with the Testing team as I two would like to sit on my a$$ for a couple of months doing nothing.

Thank you for the advice I'll be sure to include it when I begin the complaint, I just think it's wrong how they've took the chance to brand it which okay go ahead but only if you've got the effort to release ota updates on time... I had a branded HTC sensation xe, back then I didn't really understand it. Now I regret getting branded especially as they can't be ****d to keep up thanks for the advice again. Much appreciated.

Thank you, I'll be sure to keep you all updated either by pm or on this thread I've had experience as a legal executive so, I have a little experience with how regulatory bodies and ombudsmen services - cooking a storm up here haha.

Sorry to hear about your problems, if you don't mind would I be able to include your situation when commenting about the implications this delay is causing on a more important level than just aesthetic purposes? Good luck if you decide to contact three with your idea, but there call centres are as much use as a bloody marsbar right now, according to a call centre operative I should still be on 1.26 :what: and that the 'troubleshooting guide' he had up tells him my phone needs repairing. My other half slammed the phone down he was annoying him that much haha.

Fake quote, but the gist is correct: "we've held a review and found that roaming charges are disproportionate to the cost, that the charging plans are confusing and something should be done. We'll hold another review in 3 years, if they haven't self-regulated, we'll do something about it."
Not sure where you've even got that from or if you've just cooked that up in your head, but every experience I've had working along side regulatory bodies for example financial ombudsman they've got things done, so I'll take my chances.

I addressed my complaints to a named member of staff at CEO's office for 3.
After initial generalised apology about my experience, there has been no reply about the issues with my handset which are dealt with for most in 1.29 update (flicker, System Data, battery, WiFi and 3G connection issues, Bluetooth).
My One X on 3 is currently not only poor compared to others I know with same handset on other carriers, but lags behind even my HTC Desire for usability.
3 offer no clues, OFCOM were not interested. HTC blame 3. Surely with any other product this contravenes the Sale Of Goods Act, as item is not fit for purpose.
2nd handset after the WiFi issue, and now the 3rd month of disappointment with this mess.
Still no idea of how to address it though.

Good point about the rooting thing. & if anyone had a contract with three and they have a branded handset id recommend cancelling the contract if you are within the 30 day return period and getting the contract with phones4u/carphone warehouse.
