sound profile changes from vibrate to ringer on its own

Default sound profile changes from vibrate to ringer on its own

i keep my phone on vibrate all day at work. i also listen to music. i use klipsch S4a II's with the android specific in-line button. if i just use my headphones to listen to music, everything is fine. but as soon as i press the inline button to pause or double click to skip a track, my phones sound profile changes itself from vibrate to ringer. needless to say, if im not paying attention and i unplug my headphones and get up from my desk, my phone is no longer on vibrate and has rung at inappropriate times in a meeting. my note2 used to do this but fixed itself at some point. not sure if it was a software update that fixed it or a setting somewhere. ive looked all over and i dont see anything on the note3 to adjust to change this behavior. anyone else with this problem?
T-Mobile Galaxy Note 3
T-Mobile Sensation 4G, CM10 tossed in my camelbak for mtn biking so I don't hurt my Note2. LOL.
