Problem Horsepower 2.1.5 + cm10

Hey guys,i got a problem..dunno if it's a bug of the kernel or is a bug of the rom.I own a gt-i9100g with CyanogenMod 10 with horespower 2.1.5 as kernel.
When i go to performance settings i can put max frequency @ 1350 Mhz (as should be) , but after when i exit settings and play some games,when i go to check again the max frequency it's again 1200 Mhz.
In fact doing a bench with antutu when i put max frequency @ 1350 Mhz it's like at 1200..i do around 5600.
The only way to keep frequency @ 1350 is put min frequency at 1350.When u check frequency again u'll have min = 1350 , max = 1200. It's like a bug,but it works ( i scored 6700 with antutu).
The only problem is that when u are in this situation ( min =1350 , max = 1200), you won't be able to modifiy min or max frequency,You need to reboot phone to solve that.Am i the only having this problem?

any suggestion?
