I have no idea why. Have you installed it from .apk file some time before?
On my nexus 4, months ago I installed it from an apk but later reinstalled it properly after purchasing it from the play store.
Nexus 7 is brand new, opened today and never had it installed from an apk. TouchControl free installs fine.

To all who don't know this yet, this is a kernel module with a control application which allows you to wake the device using gestures on screen. For now supported options are:
- slide2wake
slide your finger on screen to wake the device (by default: left to right of the screen)
- slide2lock
slide your finger on screen to lock (sleep) the device (default: right to left but over the software buttons area)
- touch2wake
if your device goes to sleep (locks) by timeout and not by pressing power then if you touch the screen in the specified delay timeframe the screen will turn on again without a lockscreen. This won't work if you lock the device using power button or slide2lock.
- doubletap2wake
Quickly tap twice the screen to wake the device

It is made to work on stock kernel. It might work on kernels which are close to stock. I will however try to find a way to make it as compatible as possible. I'm going to assume that you can safely try this mod on your kernel (but don't enable set-on-boot) worst case scenario is a reboot.
- does this consume battery
Short answer - Maybe.
Long answer - this might bring some drain, some users report quite a big battery drain some not, I will address this issue in some time. Check yourself how much an issue it is for you.
- will it break my touchscreen
Short answer - No
Long answer - digitizer is turning off so its not working all the time. The same mod works for more then year on my Galaxy Nexus and it never lost a bit of it's responsiveness
- why do I have to pay
Why did you pay for your phone? You did save a few bucks on the phone which was cheap. Now is your chance to make those savings worthy
- if I bought it for galaxy nexus why do I have to pay again
Even though it doesn't look like it it's not so easy to make it work on new device. As you can see it's not only device specific but also kernel specific. A lot of hackery and tricks had to be done to make it work without a glitch.

First of all. please use HIDE tag to not cite big posts. By custom I mean kernel not made by google. It works with franco and faux and my own stock-modified kernel.

I use Paranoid Android and Franco Kernel v4 (on flo device) and I can't load the module.
It's fail with an error
bponury with your stock kernel I had trouble with Netflix application (based on logcat, it was failing to negotiate DRM successfully most of the time)
I had to return to Google's kernel for it to work reliably. My own custom kernel compiled from source works well too.
Let me know if I can help debugging yours, I'll spend some time assisting you if useful.
Odd, maybe it's modules support which breaks it? Have you tried faux? Does it work with that kernel?

After i installed this kernel/mod my multitouch issue is back i just had it after installing fresh 4.3 after i got the device and after a rest it was gone but NOW it came back magically is there a way to both have this mod and fix that?!

Any chance you can enable module support on android 4.4 kitkat stock kernel for nexus 7 2013 and update your app accordingly?
Because using the modified stock kernel from android 4.3 JB, on a 4.4 rom will break WiFi (that I could see), and maybe more...
Can you update your app to support Franco r4 please. He has enable module support apparently.
