There does seem to be an error with the over clocking others reported the same on older builds.
And you never had the wifi problem as it was isolated to the newest cm9 nightly. It will trickle down to aokp eventually as they are cm9 based but not for a little while

I have not tested nightly 5 but im assuming the problem will carry over unless you made a change. Whoever flashed rc 5 can check to see if they have those files in the second folder. If they do then we are golden
As to the mount point deal, i dont think that is kernel related. App data is a rom specific thing i think. Id have to look at the kernel tree again but it would seem like those of us on cm9 will have to make the switch as the dev team seem to have adopted the new mount points... Do a titanium full wipe and restore and hope they dont switch it again.

Well, SOMETHING in the kernel is causing apps to disappear... CM9 and Siyah really aren't playing nicely right now. I'm telling you. Just spent 5 hours trying to fix it... :FACEPALM:

^^ it says here in the changelog that the latest FINAL version is to include a fix for the latest CM9... Since this is RC5, and there's still an RC6 between us and the final... the fix HAS to be in there somewhere... But the source isn't on Github, so we have no idea where to start looking yet.
again. I'M sticking to the CM9 stock kernel until this is fixed. Using Siyah is causing duplicate files between my internal and external storage, and is making certain apps disappear (regardless of where they were installed) - it's very strange...
and to answer your question - yes. Putting those files in their respective places makes WIFI start to work - but there's more to this puzzle than just wifi. :-(
