Do a factory reset. This may fix your problem if its software related. Who knows what the seller tried to do with the phone before he gave it to you. Worst case, if the ROM is bad, you can try reflashing the stock ROM posted in the development section
If that doesn't correct the issues, look into warranty replacement.
On another note, maybe the phone is still in the 2 week period & you can return it. Contact the seller and find out if that's the case. He may still have the receipt in his house.
