[Q] Wifi Issues and Zune Marketplace downloads

when my phone used to be able to connect to wifi, i could download songs, fairly fast. but now it will only connect to an open wifi network, tried deleting and re adding networks, and soft resets of both router and phone. but now over 3g, music downloads are painfully slow, and almost never finish downloading. i get the cannot connect to marketplace right now error. 3g in my area is good i get around 2-3mbps download on my iphone and my atrix, so i know that isnt the issue. should i request a replacement device or is there a fix?
