I think you pretty much summed it up. Touchwiz in Samsung ROM, no AOSP launcher (Trebuchet). Proprietary code for hardware built in. Samsung ugly green theme/Candy Touchwiz I love iphone theme.
AOSP/CM9 is stock ICS feel/look/launcher, tons of customizations built into the settings menu, but device driver support + driver support is almost non existant right now due to no kernel source or source code for device drivers.

The difference is that AOSP is build from scratch, and the rom where you remove touchwiz is based around Samsung's own modified android.

No. It is not. Their deployment of the firmware has just started and they're rolling it out. If they release source within a reasonable timeframe, they are not doing anything that goes against their intended opensource contract. And breach of contract has to be called out anyway.
Give it time... Update3 source took weeks before it was released after KI3 was on Kies.

They aren't equals at all... Alot of custom ROMs use samsung base to not mess around with hardware compatibility, but remove Touchwiz launcher, theme it to their liking, change settings and remove bloatware... This makes Samsung based ROMs more usable interface wise and gives good hardware compatibility.
Cyanogenmod9 has great user interface customizability and features, but needs hardware support to make it better. It's a question of taste... Someone who likes stock might not like CM9, someone who likes Custom based on stock might not like CM9 either... And CM9 lovers usually don't like stock. Try both for a day to see which one suits your needs. Personally, I use a custom Gingerbread ROM because I don't like some aspects of touchwiz... but I prefer Cyanogenmod. Hardware limitations make me stay on Samsung though.

Stock TouchWiz is like driving an Opel minivan (last year's model it seems!) - sometimes people like to customize it by lowering the suspension and sticking a spoiler on the back. It still handles like a dog.
AOSP roms are more stripped down track cars, a 911 RS let's say. High performance which you can tune according to your tastes.
If you know what you're doin' you could get pretty good battery performance with Cm9. I disabled some stuff to prevent wakelocks, changed a few things in build.prop, deleted some unused apps, files and so on... screen time 3 hours and still 56 % left (high usage, 2000 mah battery)
do you think it is time and possible to merge ICS 4.0.4 to Cm9? cuz i know the source code is not out yet, just a "possible final version that leaked".. so the real question is, do u need source code to move to 4.0.4 or could this be done with the final version leaked?
If this is not possible, wouldn't it be, at least, consider, to move up to IML77 (latest 4.0.3) which is less buggy compared to the IMLK74 that we use here?
