I'm going to have to agree with this, it doesn't just not allow a third finger, it renders touch useless with three or more.

What he means is that the default B&N touch screen driver that we've been re-using for the 2.6 kernel doesn't support 10 finger touch. The original question was if THIS KERNEL would have more than 2 finger touch due to us having to rebuild much of the 3.x kernel from scratch or from other devices. So in answer, the Nook Tablet's screen supports 10 finger touch. But B&N was lazy and didn't code all 10 in. They gave us only 2, just like they didn't use Bluetooth, even though it has a Bluetooth chip. We will have 10 finger touch, probably not with the first stable release of this kernel, but as development goes on. I'm sure we'll see that and Bluetooth.

I could be the difference between: your driver will handle more than 2 touch points, but the firmware will only send 2 touch points.

If its a driver issue, its fixable in the kernel. If its firmware (as is the case with Kindle Fire) then it's not fixable without new manufacturer firmware.

man i hope its driver, the odds of B&N fixing that are low to none, the only reason i can think they would would be if all the avid fruit ninja players on the B&N store spoke up.

You cannot flash touch controller firmware from android, period!
Only way is with spi flasher if we get a 10 touch firmware update.
So i hope B&N didnt put into so much trouble to cripple the firmware, as it comes 10 touch from factory.
Or maybe they order a reflash
Only time will answer us.

Edit:
Due to recent Kuzma30 post it seems my words above are wrong.
My apologies to the community.
It maybe be possible to flash touch controller from android afterall.

Cosmos HD also, requires three fingers to pause, or have a menu button. But the fact is that the current driver just isn't very friendly in the first place.

I return to development process!

To make more than 2 finger support we need update firmware. In touchpanel driver there are a enter_firmware_upgrate, firmware_upgrade function. If we found correct firmware bin, then we can try upgrade firmware.
My device is NookTablet 16Gb version from Barnes $ Noble.

This was inside the repartiton flashing_boot.img that jmeyerhead posted, I had ignored it thinking that it was useless.
