First of all many thanks for the rom, proves the old girl still has life left in her! Only problem I'm having is that occasionally the phone will just completely freeze and not respond to anything, and I'll have to pull the battery out to reboot. This is especially annoying as it doesn't receive texts during this state and I end up not getting messages. Any ideas?

Yeah, that's the hardest to debug. If you could get any logs from the moment before it freezes, would be great.

If it helps, my phone has that kind of freezes with all kernels that have smartass governor. No matter if it is gb, ics, aosp or sense rom, if kernel has that governor, i get freezes and sleeps of death, even if i'm using any other governor like on demand.
Maybe a basic kernel with few governors (like cm7 kernel but ics) may solve problems. I think that all ics roms i have tried had that governor in kernel (often they are based on same kernel).
Who knows...if you remove some governors from kernel (I dont know how) I can try.

You can still use build 40 of AOKP ICS if you want features.

I don't think it can be related to a governor being present. Your device might behave wrong with it enabled, but just having it there would do no harm.

For some reason the news & weather process kept crashing and now the screen didn't turn back on when there was a green notification light so after a reboot it says that the process com.android.phone has stopped and each time I click OK the error keeps popping up so I can't actually get rid of the message --- so cannot use my phone.
Is there any logs or anything I can provide you before I flash a new rom on it?
Sadly my nandroid backup failed, it got stuck on checking MD5 sum and drained most of my battery

It is a bug in AOKP, and since AOKP ICS is now frozen, I see no reason to fix it. Just reflash.

EDIT: Managed to boot the phone back up without crashes by wiping cache and dalvik, however I cannot open any apps up anymore as they all FC. Browser worked so downloaded the new ROM file!
EDIT 2: Just flashed build 40, but in about phone it still says Build 39 in Mod Version?? Any ideas?
