I am facing one issue as i mentioned earlier. I am using the latest build. after using couple of minutes like 5 to 10 mins the top right side (near volume control and power button) is getting hot.

Anyone facing this issue ?

Allow me to assume you're using the stock dpi (160) - ie. Tablet UI. espionage724 sums it up concisely in his comments below ...

Navigation bar stays on-screen during full-screen apps with Tablet UI. The bar disappears during full-screen apps on Phone UI (similar to Gingerbread).

Phone UI on ICS is similar to Gingerbread I guess. Tablet UI is standard in AOKP, CM9, and other ICS-based ROM's here (i think)

I do notice that when gaming esp. Can only guess that's where the cpu or gpu is located.

Do you by chance have "Force GPU Rendering" enabled in System / Developer Options?

I read somewhere that enabling it may cause issues in apps that rely on software rendering. A moot point since you have it disabled, and I don't think it had much relevance to your original question anyways. Oops ... brain fart!
