NFC Tags ICS issue?

I remember reading about a ICS bug that would prevent you from writing to blank tags and they had to be NDEF formatted first? I know Google was working on the issue but I never heard if that was fixed in 4.0.4 which we will be running on the Eltevo. I purchased some tags form Tags for Droid and saw that these are empty and not NDEF formatted so just wondering if I will have to find a program to format them before use?
