How come we can post TomTom programs here but not on ebay?

I was selling my Xperia X1 on ebay and they have removed it because I am selling it with TomTom on it. How come tomtom have a go at ebay for me selling a phone with tomtom on it but they havent said anything here where you can download the tomtom program for free? I am not selling the phone with any maps just the tomtom program.
