Default Rooting a Subsidized phone?

If I was to (Potentially) root an o2 subsidized phone and something was to go wrong, would o2 be able to charge me for anything (apart from repair of the phone)?

What I mean is could they "sue" (for want of a better word) me?

It would invalidate the warranty if they found out (and prove) that you have altered/change something on the device that you shouldn't have.
