I just tested my headphone this morning and they work fine. I am not sure why yours would stay at max volume. Does it not change the volume when you use the volume controls on the headphones? What if you change the volume on the phone itself, does it still stay at full volume?

Well I deleted the PDF's, restarted, tested it again and I still lose about 1% every 4 mins that the screen is on. It seems to be regardless if I am on Wifi or 3G. Even if I close down all my applications and just let the phone sit, it still looses the same amount of battery.

I use a combination of Battery Doctor and Clean Master to figure out what is eating up my battery. I normally don't actually use them to kill apps and services, but instead use it to find the problem, and then take care of the issue myself.

I haven't tried the headphones yet that came with the phone, but I will try them tonight to see if I have the same issue.
