Any chance you use multiple gmail/google accounts on your phone? Market might have logged you in under an account that you have never downloaded anything with in the past.

I had trouble with that in the past also but i know there are 2 footer images in htcresources. I just took a look and found common_update_footer.9.png & common_footer.9.png. I think its the second one.
