Make a backup of boot in twrp before flashing a new boot img.
Simply tap on backup and untick all except boot unless you want a full backup.
By the way i recommend doing a backup of system because if you break anything you don't have to flash the whole sd card because we have no zip to restore system but a backup will help.
/data can be formated to reset the rom.
So tick boot and system to be safe.

Homebrew is illegal if it's used to hack something.
Cheats and stuff is illegal.
But in case of android you don't touch Horizon OS, you don't touch the built in eMMC, you don't "hack" the switch's OS to run unsigned code or run cheats and mods in games, you're not able to dump games for piracy nor you're able to run illegal game dumps.
YOU owned the switch and it's yours and as long as you don't hack nintendo stuff there is nothing nintendo can do because the physical unit is yours.
(Nintendo-) software things are something different.
I also wouldn't call android "homebrew" because it isn't based on the switch OS, doesn't run unsigned code on it's OS and don't hack nintendo games.
It is a custom rom and the use of custom rom's isn't illegal as long as it doesn't infringe any copyrights.
Custom rom's are very common on android devices.
They're not illegal but the manufacturer don't like the fact, so they add fuses and create locked bootloaders.
In case of huawei for example, they no longer allow it to unlock the bootloader, so you can't run custom rom's.
But some manufacturer even support the community, upload kernel source code and has a offical way to unlock their bootloaders (for example htc dev).
But almost every device get's a "tampered" flag through fuses as soon as you unlocked the bootloader and from now on the repair centre know's you no longer have warranty and you have to pay for the repair because the damage could have happened from running a custom rom + kernel with overclock options and your phone burnt out or something like this.
Please if i'm wrong, someone has to correct me before spread bull**** but that's what i think about the situation.
