Dis regard this i fixed it... Turns out that when i did the splash screen to have the Mytouch splash screen instead of the HTC magic one i had did an spl that wasnt for my phone i guess so the earspeaker wouldnt work only in speaker mode so i then used the stock spl through sdk or whatever thing...
