That would be false as I bought mine the first day it was out and I still don't have the update.Still no update here (Bellevue, WA). It is a stock, non rooted, US WiFi model, purchase at Best Buy 2 weeks ago.
I doubt that, for a WiFi model, the availability of the update is location based... probably is linked with the serial number (maybe the device purchased earlier, have earlier firmware update)

I really don't think so... I could understand a country level filtering, but a state level... that really don't make sense for a WiFi only product.Ohio here if that helps anyone...since I think it goes by location
