Any UK contract experts .. advice needed plz

I am a happy note 7 user . lol .. i'd like to keep it but due to the fact there is unlikely to be ROM updates and the phone will be worthless in a few years it will have to go back

Bought from CPW on EE on contract
£99 deposit + £46/month for a 10gb/unlimited calls and sms
so by the time it goes back there will of been 2 full months charged for.,
CPW say to take to back for a refund of £99 and cancel contract..
BUT !!!!
My monthly fee includes a charge for the phone .. so i want that back ... NO NO say CPW .. its a £99 refund...
i'm happy to pay my call charges for the 2 months .. but why should i let them keep 2 months towards the phone payments !

next problem .. i ported my number into them .. can't lose the number and I'm getting feedback off them that retaining my number or porting it out again could be a problem as its a contract cancellation and they have only ported it 6 weeks ago..
reluctant to spend hours on the phone to CPW arguing as i spent £15 calling them last month on there umber that conveniently is not included in call packages

the problem with most contracts is the phone and call package is combined, it makes it hell getting out as you have to pay off call package and phone cost up to the end of the term, it's why I have always stuck to O2, with refresh direct from them you get a credit agreement for the phone and a call package, the phone finance is the thing that ties you to the contract so no matter how quick you pay the phone off you can cancel the call package or upgrade, I realise this doesn't help in your situation, but basically they have you over a barrel as you are technically just paying for a service, it's the same as they will happily keep you charging you that monthly fee once the 2 year period was over.

with mine for O2, my call package stays active and they cancel my finance agreement and give me back any payments I've made.

unfortunately if you want to keep your number the best bet is to get them to supply an alternative phone under the same number/contract instead of refunding with just a price adjustment or if you plan on going to an old phone ask that your contract be downgraded to a sim only monthly contract.

While the monthly price does obviously include the price of the phone (and then some) there is no where in the contract where it specifies that. Going by most contracts they agree to let you use the phone in exchange that you promise to stay with them for however many months the contract is.

If the phone was £750 on a 24 month contract that would come to about £31 a month... where would you find a 10Gb 4G+unlimited voice and SMS contract with no phone for £15 (46-31)?

What I'm trying to say is that officially, as written in the contract, they give you the phone for free (in your case with a deposit, that you would get back at the end of the contract) in exchange for you giving them your business.

so not only are many of getting done over and probably being forced into having a different phone that we probably don't want but the network is doing one on us as well ...
if only this was USA there would be lots of ppl yelling for a class action law suit lol
