All Facebook, Twitter, and publicly shown advertisements at numerous electronic conventions and web based reviews from numerous sources for your device say nothing of such defect and no mention of defect is outlined in your description of the Saygus V2. You have willfully shown your device to be defective and I'm requesting my refund due to this defect since I have owned numerous cell phones in the last decade and have never had one of those owned phones come apart as yours have. Saygus has physically demonstrated a defective consumer commodity and it would be unusable and impracticable in my personal daily use of your product.[/FONT]

[FONT=&quot]My complaint concerns a business within your state that is currently running a starter campaign on the website Indiegogo.org for a product called the Saygus V2 smart phone. I contributed to the campaign to receive this device when it is produced as the company say's near the fall of 2015. After contributing, SAYGUS Inc. released a self produced video showing what I perceived as a defect. I immediately wrote the company since they have no phone contact information on their website and respectfully asked for a refund in accordance with Utah State Law. Many red flags have appeared in my opinion concerning this business and their honesty. I'm including below a copied and pasted transcript of the support tickets between Saygus Inc. and Myself. Please have someone in your office look into this matter and verify whether the current over 1700 consumers who are contributing to this campaign and the over $1,000,013 that has been contributed thus far will be treated correctly as consumers with fairness and in good faith.[/FONT]

[FONT=&quot]As I’ve stated in support ticket #18332 Saygus closes support tickets prior to clarifying with a customer whether their needs, questions or issues have been resolved; as I’ve noticed support ticket #18787 has been closed. Sorry but I’ve never been a part of this type of customer service. As I elaborated in support ticket # 18332 of the office drop test video where your product the SAYGUS V2 back becomes detached from the phone at a 3′ drop and every drop after until the drop tests are stopped at 6′. Defective is a relative term and it’s my observation of this SAYGUS produced video that displays to me who gave “a contribution” for the receipt of your product 1 each SAYGUS V2 cell phone that in my opinion and with my daily use of such a product would not fit my description of a useable smart phone in my service; so instead of needlessly keeping the order open I am doing your company a favor by asking for a refund on a product that has not been delivered and has yet to be manufactured or produced. SAYGUS is entitled to their opinion of course but I would never purchase a smart phone that I considered defective so thank you for supplying the video.[/FONT]

I was given the name of SPENCER BAILEY at email [email protected] by JESSICA at Indiegogo as the owner for the SAYGUS V2 campaign for any refund questions I might have. Part of Indiegogo Terms and Conditions are that the owner of the campaign is responsible for all matters relating to refund till the campaign concludes. If this is not the correct email then please indicate that as part of this conversation so I’ll have proof of a non registered email through Indiegogo.org. I have written two emails to the SAYGUS campaign owners email [email protected] about a refund and have heard nothing. Seems to me their is no such email and correlates with my observation of SAYGUS ignoring me. I also wrote SAYGUS on June 17th on the same support ticket #18332 about their intent to provide whether my requested refund would be processed and to please let me know as no confirmation was given at the time a support person replied and that request has only been answered now. The only time I get a answer on anything is when I open a new support ticket so I opened another support ticket to gain answers to my questions. Again these our my personal observations as a customer and may not be how SAYGUS handles their customer service.[/FONT]

Wow. I think I have a defective phone as my Samsung S4, when dropped the battery flies off with the back cover. In the meantime I put a case on my phone and the problem has been resolved. I know it's just a workaround but I can live with it.
Sounds like good physics at work. I switch around between the Z3 Compact, Nexus 4/5, and my Galaxy S i9000 phone. Right now, I decided to use the i9000 phone until our phones come in. I'm surprised KitKat works so well with phones with less than 512MB RAM. Of course: I adjust my usage accordingly but I always impress myself that I can still make a 5 year old phone work today for most daily things.

The video you are most probably referring to, has been published on April 24th 2015.
Just curious: When did you place your IndieGoGo perk? Was it on April 23rd?

Saygus displayed a office drop test video in which the above mentioned phone was dropped from various heights onto office type furniture and the back of the phone which held the battery in place did detach from the phone at various heights. I don't see any place, where Saygus announced that the V² is very ruggedized (and made to periodically drop it). Furthermore I highly doubt that devices of other manufacturers will show a very different behaviour in this case.
Maybe you should try to sue Apple, because the screen/glass of the iPhone can break when it's being dropped and this behaviour isn't mentioned in their marketing campaign. :p

I agree with you. This Cherry person is an idiot if they think this is a real defect.

Sorry, but I call BS!!! You have no claim, and should of figured it out before dropping money on an IGG campaign. No refund for you!

I found this rather interesting comment in regards to Osborn, Australian computer maker from the 1990's - on theregister.co.uk

No still an diot. That's like telling Ford, "I saw someone back their car into a pole and their bumper got dented. Your car is defective now give me a refund."

If they do get a refund , which hopefully they do, it won't be because of their bs defective claim. Instead they should call their credit card and reverse any charges.

You could try taking Newton to court because he discovered Gravity, I mean it seems definitely his fault because if he hadn't discovered gravity your phone; that you haven't got yet, wouldn't ever hit the ground.

hmm ground ... I wonder if you could sue Gaia? got to be her/his/their (well I dunno) fault, if there was no Planet Earth then your phone would be like totally safe from hitting the ground!

Of course it could always be your fault for dropping it?

Hang on you haven't even got it yet, and you want a refund; from a crowd funding site, in case you drop it and the back comes off? or did I miss something? (to be fair you'll have to tell me as I only read the first bit then sort of skimmed through to the end) sorry. :(

fwiw, I did get a refund from them in a timely manner (though again, I am in the US, I am sure that is why I received it quickly). I am not a saygus employee. Look at my join date.

Finally got my refund today. Never ever have I seen anything so absurd.

For those of you waiting if you have not received the email saying refund approved you need to call them. Then it will take roughly 10 days from the date you get the email.
