No it isn't the early termination fee is a fee you agree to pay if you break your contact the type of device you have under contract does effect how much they charge you for the early term fee the Next program with AT&T , One Up with Sprint and the other deals like these are finance programs for people that want to upgrade every 12 months and do not want to be trapped in a contract so what happens is since you are not under a contract you don't get the contact price for the phone you pay full price for the phone but the price is split up into monthly payments on top of your regular monthly charges and you are not under contract you can leave at anytime without paying the 300.00 early termination fee but you still have to pay for your device

I see what you are saying but the agreement with the Next is strictly for the price if the device period nothing else it is kind of a like buying a car lol you agree to pay so much for the car per month and in so many months it is paid for but if you don't pay it gets repoed but with the phone you can keep just pay the remaining bal of the phone with no other penalties

Your still under contract. It would cost less for me to break mine than it would for you to beak yours (read above post) I pay no penalties for being under contract, so I dunno why you threw that in there. Your gonna loose your note 3 if you ever want to upgrade unless you completely pay it off.

You probably talked to the same dumb ass that told me I didn't qualify for the next program but I waffled in the store and was out in 20 minutes lol don't believe what call center reps tell you because they don't know **** lol just like sprint I talked to them about the One Up deal and they directed me to the store because they didn't know any info on it the call center reps are given limited info on everything I'd any they will tell what they have to ttjust to get you of of the phone so they don't mess up their handle time on the call lol I know what they do because they train you to do that especially if you are not actually purchasing anything you wasting there time I did it because like I said I don't have a contract and have paper staying this and I can leave whenever I want to yeah I agreed to pay for the phone no big deal I agreed to pay for the Chrysler 300 that drive and my Lincoln lol but I am not obligated to stay at that car lot for 2 years lol and as far as keeping my old phone it doesn't matter I always trade them in anyway why keep a phone I am not going to use

Well I guess in your eyes I'm not in a contract either because I can leave whenever I want if I pay an ETF. Basically it's the exact same situation with you. You have to pay a "fee" to leave out of your "contract" early. I dunno about you but that sounds like an early termination fee to me, just more than I would wind up paying. In that case you would get to keep your phone. You keep on referring to your cell phone loan and your vehicle loan and using bogus examples that don't correlate with each other. Instead of saying you aren't obligated to stay at the log for 2 years you should have used fuel. You can't use your phone to its function without service just like you can't drive your car without fuel. If that said lot was the only place you could fuel your car you'd have to go back and refill your fuel (or data just like people that go in store to pay their bill) to use the vehicle. Your only obligation is to pay for the device. The service is paid to make it work. There. Fixed that mess for you, next the information was gathered by actually calling att and going through the steps to deactivate my account (they have a separate extention that deals with all deactivation requests). I got the numbers I needed before she finalized the deactivation, explained why I did what I did, thanked her and asked her not to continue. Those numbers are as solid as they can be, check for yourself if you don't believe. Lastly you don't have to keep the phone but why give att back the device you've half paid for? Sell it on Craigslist and use that money towards the next device and bill.

Yeah I don't see them honoring previous purchases lol I have only had mine a week but from what I understand you have to sign a2 year agreement and I am not under contract so I am good I just bought 2 of thethose tablets 3 days ago for my daughters for Christmas
Your original post. You were fine until you said you weren't under a contract. I don't know how hard it is to understand that there is more than one type of contract. I signed a 2 year agreement and you signed the next agreement. They are both contracts weather you realize it or not, even the ATT website says so. Your analogies with the vehicle were so flawed in so many ways that I didn't even pay them any mind, I pretty much skipped over that section of your posts.

You are under a 2 year service agreement by which you are tied to them for that period I am not if you leave right now you will pay a penalty I on the other hand will just pay for my phone in full instead of payments the only reason you paid 299.00 for your phone is because they give a discount for signing a2 year service agreement or contact

Yea, I understand all this already. If you decide to leave now your penalty is having to come up with the amount for the rest of the phone. You would have to owe att 600 or so to leave them. It's basically the same thing except you have to pay for your device in full where I do not.

So tell us, what do you feel next is better than signing a 2 year agreement?

You would have to pay for your device in full if you cancel your service anyways, no different than paying an etf. I can upgrade every year as well, just pay my etf of 195, upgrade and sell my note on Craigslist and make a profit. Your going to loose out when you upgrade. The benefit of the next program is not having to pay up front. There is no difference in paying the etf or the rest of your next loan besides the etf will be cheaper because you had to pay up front when you got the device.

I would have to pay full price for the phone anyway whether I stay or go because I dig Sgt sign a service agreement and if you think about it you will be paying pretty much the same price I am. .. You bought your phone and paid upfront and if you break your contact you have the etf to pay which equals out to about the same amount and you have to sell your phone break your 2 year agreement then pay for another phone just to upgrade every year when I simply walk into the store pick out the new phone give them the old one and leave no hassle no 2 year contract I am happy. What people don't understand is by the time these phone companies give you a deal on your phone for signing a2 year and proving the services that they offer to you they don't make any profit off of you until almost the end of your agreement that is why they charge the etf if you leave before the end of the contact

This is where I believe they are getting people. Sure it's less hassle to use next but let's look at this.
I paid 299 up front and would have to pay 360 etf the first month. An eft is prorated at around 10 a month. So every month att is actually helping me pay for my phone for paying my bill, something I'm going to do regardless. The etf is only to make up for subsidizing the phone initially. In a year my etf will be 195. 299+195=494+199(next phone)=693-500(Craigslist Note)=193. I'm still not out any $. Lets look at your situation. 35×12= 420 and you get a new phone. Now your out 420. Next year you'll be out some more. They are actually making double off of you. Att makes money through service charges not selling phones.

Like I said I have worked for 2 out of the big 3 wireless carriers and they all operate the same and I could sit here all day and explain things to you and you wouldn't truly understand until you have been on the inside and see how things go down and yes they make money off of service and equipment but they don't start seeing the profits until about 8 months into the second year of your contact because they still have to pay Samsung 700.00 for the phone they just gave you for 300.00 and the cost to maintain the network and all they break that stuff down to you when you work there and go through training that's why I laugh at people when they say they spoke with someone over the phone because 95%of the people that work in those call centers barely know how to turn on a phone most of what they are telling you comes from an internal data base or script that is designed to get you off of the phone as quickly as possible for example when I worked at VZW I had 3 minutes to get you off of my phone no matter what your issue was our I got in trouble so I would tell you anything you wanted to hear to get you of the line I would even transfer you to get you of my phone lol

And I understand how these companies make money, it's simple really. You don't have to be on the inside to understand it. And I only call a call center to get information that I know is in black and white. I wasn't calling her to confirm weather or not next is a contract, that was just obvious. It's disguised, but it's there.

I kind of like the argument. It might help him actually understand his agreement with AT&T as a lot of people do not. And Next is absolutely a ripoff as are all the other "early" upgrade carrier deals.

Example: One of my employees came in to work bragging that they got a Note 3 for $300 without a contract. I asked how she did it and she said she got it at a Sprint kiosk at the mall and that for sure it wasn't under a 2 year contract. Then I pointed to her paperwork that showed a 2 year agreement.

A 2 year agreement is a lot of money over time. Read and understand what you are getting into.

Any time a person on XDA or any of the other device/carrier forums on the Internet says this I immediately disregard their posts. Selling cell phones at the mall does not equal some sort of omnipotent knowledge of specific carrier or overall industry practices... it just means you sold cell phones at the mall.

The guy who details my car doesn't try to tell me he's an auto industry insider because he's washed 9 of the 10 major car manufacturer's cars.

Oh and the Note series will probably see 4.4 KitKat when the Note 4 comes out in late 2014. Happy waiting!
