You can change your IMEI. I don't know how on the N1, but it's possible.

Oh, and it's completely ILLEGAL.


I will never buy another phone from google.. they let us down the only way att got the imei's so they could bump us to the 30 plan was if google or htc gave them the imei's..

i never have problems with my kids n5800s which get 3g or my n97 or i8910 ... only the n1.

am selling it on ebay and getting something else maybe i9000 if it comes out if no carrier picks it up.
Also you are wrong on ALL levels.

fraud is defined in the Communications Act of 1996 as in terms of cloning for the purpose of fraudulently billing someone else for your calls.

But I don't believe ANY law deals with IMEI in the US in terms of spoofing.

All I can say is, I'm one of only a handful of people who had court appearances based on the Communications Act of 1996 shortly after passage. I know it pretty well. Also, when we were hacking bag phones and brick phones, ESN was just ONE of the things we could easily change. Today's hacking isn't to the same degree as it's really just customization.

That's old wive's tale, not old wise tale. Not sure about the legality of changing the numbers themselves, but something tells me in this case it would be used to mask a smartphone as something less so that it could be used on a plan it would not otherwise quality for, which would not be legal.

I have a FAN account and I have the $30 unlimited MEdiaNet & unlimited texting bundle and so far I haven't received any texts or emails and it doesn't show my N1 when I check features. Not sure if I have the Smartphone Exclusion on my account or not

I'm also not a heavy data user since I usually use WiFi, so I average 100-300Mb/month.

Nope, you may be breaking an AT&T policy, but you are not breaking the law. The phone you will be using will still be entirely billed to your account (data and minutes - no fraud for usage is taking place).

It may actually be more criminal that some people get billed one rate for 2 gigs vs. others that get charge a different rate for the same 2 gigs. Making people pay more because they enjoy it more is just fucking stupid.

Both parties signed a contract agreeing to certain terms of service, but unlike phone phreaking in days of yore, where you would use pitch modulation to simulate payment at a payphone and thus gain free use of an otherwise paid service, in this case you are simply modifying your configuration settings to allow for services not otherwise offered for your particular handset. It may be ethically shady, but it does not constitute wire fraud (as far as I know).

The main reason for the Communications Act of 1996 was people were sitting on overpasses with a scanner and a laptop and snarfing ESN/MIN pairs out of the air and programming them into cell phones and using them until they got cancelled. One hour on an overpass could yield you enough ESN/MIN pairs to last you for years.

THAT is fraud. Clearly not the same as changing the IMEI on your own phone and paying a bill for your own usage.

If I could change the IMEI's on my HTC phones, I would and would create my own IMEI string that doesn't identify as ANY manufacturer. Screw 'em.

AT&T F*CKED me in the store yesterday... Did an Eligibility Swap with the wife, which they said would not affect our voice or data plans yet they deleted and re-added all of our features, which of course took away my grandfathered MEdia Net.

So before I start screaming until I'm blue in the face, is there any way to get the plan back? I believe the answer is no... So I'll at least pursue getting a discount in order to reduce the immediate monetary effect of the unauthorized change.

I feel this is yet another example of A&T reps removing/adding features to get compensation.

BTW, I argued with them for 15 minutes in the store about what they had done, but they insisted that the data plan they put me on was the same thing, different name. Of course I knew different, and within hours got my text message.

Awesome.. Just looked at the OLAM, I of course got switched to the DataPro 200M package, and I see zero other options. F*ck you AT*T.

Note: AT&T is telling me they will twiddle ALL of your lines if you're changing any of them. Love that. I should have copied the online chat I just had but I got pissed off and closed it. Basically they said during any upgrade or line add, they'll adjust all features on all lines.

that right there is why i buy 2nd hand from here or off craigslist...

as far as forcing a change on all lines, thats bull... when you do an upgrade on a specific line, your only signing a new 2yr commitment for that line... they have no right to touch any other line on your account. the last contract you sign on each specific 'line' is what your obligated to...

ive bought many a phone used and just switched out the sim and off i went...

example, ive got a family plan with 5 lines, 2 of them the contract is active for another 1.5 yrs, the other 3 the contract has been expired for a long time...
all still in the same family plan...

Umm the store should be able to fix it if they said nothing would change. If not, call customer care and escalate to someone who can put the $30 unlimited data on for you. If you don't cuss them out usually they will help.

Yes, this is the plan today.... But still, they flat out lied to me about not changing my features just so they could slam some stuff and toggle some bits.

And in the end my bill goes up $15/mo.
