You're installing an ND8 ROM, not an MD4 ROM. Like instructed above, use the ND8 mod.
got it after I sent it I started reading around and it started to make sense Its a different rom nd8 for the 4.4.2 upgrade.
question
the install instructions for the nd8 rom says
"put phone into download mode (power off, then power button + Volume Down, then volume up when prompted"
has that changed I checked download mode this morn on spring s3 I used
down vol button+home button+power button
I got the screen that says in small red letters at the top odin,
btw the nandroid backup went smoothly to the external storage card. :)

It's probably referring to using Odin to update the bootloader before flashing the ROM.

the instructions pointing the install to odin which is what I used for the L710VPUCND8_L710SPRCND8_L710VPUCND8_HOME.tar.md5 file, the install whiped the data from the phone drive treated it as a fresh install, I was able to recover with my backup nanddroid copy flipped everything back to the way it was. should the install of the above file be done by odin or cwm?

If you're installing a ROM it's always in recovery.

ok got it, I'll drop file in root of phone and point to it in cwm. anything else I need to look out for or do first?
you mentioned "update the bootloader before flashing the ROM" need to do or should do or you can skip it?
If you're on the ND8 Bootloader/baseband then there's no reason to. Check in Settings/About Phone.

trying to install the rom as a zip file in cwm, cwm ver philz touch 6 build ver 6.41.6 cmd2lte.
error installing update ,installation aborted press any key to continue,
should it be installed in cwm as a zip file or a tar.md5 I tried both.
I checked the baseband ver it is now showing L710VPUDND8, before it was L710VPUCMK3.

No need to Odin then, the error message means you have a bad download. Delete it and download again. Only zips are flashed in recovery. There is no reason to Odin anything so everything should be in zip format.
