1. do it yourself. Decompile framework-res.apk and edit one line (can't remember) to true and recompile, sign and you will have it.
2. how to you acces Menu for legasy apps designet for below ICS? Like ES File Explorer.

Please make 3 dot version! on my mini pro i modded the keylayout, so i ve got app switch key instead of menu key, so i need virtual menu key!

how could we mod menu key to apps switch key? anyguide? some flashable zip? I just want that too. thank you...

Maybe the settings.apk from the screenshot there is not the the stock one... Maybe it's the smart settings. I see...

go to folder: /system/usr/keylayout/
open cyttsp_kay.kl with text editor

find line:

key 139 MENU VIRTUAL

and write thid instead of "MENU": APP_SWITCH
