Wish I had one of those new 1.4-1.5Ghz devices.. kinda disappointed some of the new devices are still rocking the 1Ghz CPU, but maybe the new GPU helps some as well.
Trust me, me too. I guess I wait because I'm on Verizon and we'll get the last one, if we even get one.

I know it's tempting but, if your creating an app, shouldn't you stick with something about 95% of the people have to make your market larger?

http://www.wpcentral.com/sam-alert-nes-titles-still-being-sold-new-ones-added

I can't believe Microsoft doesn't remove a stolen emulator with roms in them.

So I've decided to submit the beta 3 to the marketplace, to see if we can get a clear answer regarding emulators.

I just have to sort out a few things, then I'll get a xap link for the rest of you and I'll keep everyone updated regarding the marketplace submission.
I have been watching that too. As a legal standpoint, upload your app with NO ROMS or just home brew only. There is nothing wrong with that. Nintendo is very clear on what is legal and what is not (it's right on the FAQ on their website) when it comes to roms.

How this guy/gal is getting away with this is beyond me. If they block you then there is a major problem here.

I guess we all wait till Nintendo says something. Unless this guy/gal has a legal right from Nintendo to do this.

But, he's making money on it as of right now, something is wrong with that.

I'll definitively continue to optimize for the first generation of phones, but I've hit a pretty tough roadblock regarding the drawing apis.

Yeah that's what I'll do, I just have to add a few legal things to keep myself covered since the original vNES is under GPL v3 and therefore this one is as well.

The whole legal fuss about emulators are very unclear, some say it's legal to have a backup of your own copy and Nintendo themselves don't. They even say emulators infringe on copyright/IP even though they are protected by reverse engineering laws from what I can glean.

I highly doubt Nintendo will ever start releasing NES games themselves on a non-Nintendo device, there are cases of for instance Capcom releasing the Mega Man games on iOS devices, but they own the games so that's a different story. Also they wouldn't have picked this lowlife to do it, just check out some of his other "games" it's laughable.

Even spoke to some of the Chevron guys, Rafael Rivera, Long Zheng and even they can't make themselves heard with Microsoft.

It's been a battle that has been going on for many years, on almost every game OS at some point.

Nintendo has been very clear what their legal standpoint is on this whole thing. They also have a right (I'm sure they have a very large legal team) to protect their own products, that could apply to any 3rd parties apps made for their systems as well.

If you have an hour or so to read....

http://www.nintendo.com/corp/legal.jsp

So, your in the clear, as long as you don't put any roms with it.

Microsoft's view could be it's a game "like" the console game or a game based on the console game, not a emulator. At one point they did say, No emulators.

It will be interesting how it all plays out...

lol I actually started reading that, but there's never been a court ruling against emulators, even that old ps1 Bleem case ended up on their side, even though they spent so much in legal fees that they went bankrupt if I remember correctly.

Microsoft is really giving mixed signals, and they're clearly violating their own rules here.

http://twitter.com/#!/BrandonWatson/status/27087440149749762

And they've shut down a NES emulator in the past.

When it comes all out to it, who knows what is really right or wrong here and what is legal and not. I'm sure if you google it, there will be a lot of discussions like this on it, with laywers in the discussion, as this subject has been beaten to death.

As for the person with the emulated games in the marketplace. I really think, in time, unless they have legal permission, they will get in trouble. Nintendo has very deep pockets, they might not win the case (well, selling emulated roms..hmmm) but, could send the programmer into bankruptcy with legal fees (AKA shut him down). You need to have some balls and a lot of $$ to take on a major company like Nintendo.

I don't want to take away from your app, it's great and as long as you don't include any roms with it, it's legal too. What the end user does with it, is their problem (maybe that is Ms's standpoint why they are being blocked).

It really will be interesting how it all unfolds....

Yeah he's already violating GPL/BSD by copying the nes emulator, not quite sure which license XNASharpNES is under. Not to mention completely morally bankrupt. I'm sure selling roms are considered very illegal and it's pretty dumb by msft to defend this tard.

Nintendo isn't really known to sue people, but I'm sure they'll do something once they are aware, but really Microsoft should have never approved these "games". I'm pretty sure theft are against their terms of agreement.

Nintendo only really chases down rom dump sites or if your trying to sell rom "sets". If your a website hosting NES, SNES, N64, DS, 3DS (yea, already hacked), and you have a volume of people going there, you will be sent a legal letter to stop, in time.

They never go after the small guys but, some have gotten a letter to STOP, if they are known to have tons of roms publicly (a blog writer got tagged after publicly posting that he had thousands of roms).

Now, on the other side, This guy is charging for this app, AKA making money directly off a rip of a Nintendo rom, that is a whole different story. It's just a matter of time...

Anyway, I"m looking forward to your next update, this was one of the main reasons I wanted to unlock my phone :)

Huh, didn't know the 3DS was already hacked, though I read something about roms being dumped, but u can't play them yet.

Yeah selling roms is a big nono, any way u do it, just disappointed in the way MS is handling this.

But anywho, I've submitted a slight variation of the beta 3 to the marketplace, so maybe we'll know once and for all their stance on emulators in a few days.

I'll have the xap for the beta 3 up shortly here as well.

I saw that on a underground blog I watch. Can't confirm 100% but, it sounded like they got them working. Honesly who cares, there is only one game for the system that is just OK. They released a system that has 5-6 crappy games and nothing due for a while. No wonder sales are slow.

Wake me up when they release a 3DS lite..... The only game I will really want to play on it will be Mario Kart.
The New Super Mario brothers is the main reason I got a DS (then a DS light) and the same will happen with a 3DS. When the new mario comes out, I'll comb ebay and criegslist for a cheap 3DS.

So, yea, I agree

The OoT remake is more than ok tbh :p, but yeah the game lineup has been pretty lackluster. If it weren't for virtual console, I prolly wouldn't have used my 3ds at all since I finished OoT.

The new Kid Icarus game looks pretty cool though, also looking forward to the new Mario game. Galaxy1&2 were pretty damn fun.

No question, one of the reasons I wanted a Wii in the firstplace (the New Mario game was pretty awsome too).

I loved the Galaxy series
DKCR is pretty awsome too.

Btw the beta 3 is now out, I've updated the first post with details and such.

http://nudua.net/files/vneslightbeta3.xap
http://nudua.net/files/vneslightbeta3-gameshub.xap (puts it in the Xbox live hub)

The most notable changes are fixed web downloading and support for isolated storage tools. (u can add/delete roms and backup sav/sram from it)

Hi! great job here, wondering (even though the log to beta 3), has there been any improvement done to fps and sound capabilities? :)

If I can get the emulator up to 100% speed, then sound will work properly.

I've hit kind of an roadblock regarding the fps, but I'll continue to try to optimize it to increase the speed. It should run a lot faster on the new devices though.

Oh,well can't manually browse, Access denied (I'm Introp-unlocked but, it's mango thing with permissions).

I like if I am in the middle of a game and hit back, I get the menu and can do a real time save, AWSOME ! (I guess I can play kid Icarus, I was not going to write down those dam codes !). I downloaded the tools in your first post.

I think I found out my little disike, maybe it's just me but, the arrow keys are too far apart. I use a thumb and lean it side to side to move, problem is I have to pick up my finger to do some things and it makes some fast parts unplayable. Anyone else notice this or is it just me ?

Bug: disable frame rate on display, you lose video for your game (tried this a few times trying to figure out why I was not getting video.)

Enabling audio can make some games drop major frame rate and it's just choppy audio (really wish you could do something with this one, audio is 1/2 the game)

R.C Proam still has video issues. :(

Nice update tho, looks a lot more finished and refinded...

Oh, I keep forgetting, Here is a gift for you. The backgound image I gave you (that looks awsome for your splash screen) but, with a White background (sized to the 800 X 400). So if someone is using the light theme, it will be light as well and would look a lot better....

Ah sucks that your're interop locked, I've got a normal dev unlock and it works just fine, maybe it's about time that Chevron unlock comes out.

The menu and realtime save was the last thing I added to the final of the beta 2, maybe I should have told the preview testers :p

The hitboxes are bigger than the buttons, so u can slide your finger over. Even diagonal movement should feel a lot better. I'll tweak the controls when I sort out the graphics for them.

Hadn't noticed the fps bug, I'll sort it out.

That's dependent on the CPU usage, which is about 90-100% currently, there's not much I can do about it than trying to optimize the code etc.

R.C Proam still has video issues. :(

I've had no time to fix the mappers. It's on the list though.

Wish I had more time to really polish the GUI stuff, but there are more pressing things like speed etc. and this release kinda got rushed because of the marketplace submission.

Sadly there's no way to swap out splash screen images dynamically unless you use it after the app is loaded. But people could swap out the SplashScreenImage.jpg in the xap if they wanted to use the light version.

As always, appreciate the feedback.

I sent my image on the other page. I attached to see if you wanted to use this one or something else. I'll break it up into 4 images if you want so you can use it. Just let me know the size of the hit box graphics (or each control), and I'll do it for ya.

I thought there was code to check the theme loaded ? Then you can load based on theme.

No problem, I look forward to your next beta !
