NFC can be set so that it can be used while:
The screen is off
The screen is on, but locked
The screen is on, and unlocked

Navigate to Settings > Wireless and Settings 'More' > NFC Polling Mode.

i only can choose "nfc on/off" ...
do you use a custom rom?

It isn't a feature in jellybean but I know there are several roms that have added it in. One of which is aokp. Otherwise if remember correctly there is a thread in the themes and apps section with a flashable zip that was originally for ics but I think they have updated it for jellybean.
