We had to patch navigon t mobile too it was locked to the carrier. The original xap from the marketplace didn't work with other carriers.

You mean you got it in the Market Place ?
You didn't deploy the xap ?
You enabled the Nokia MarketPlace on your non-nokia device and you installed the new nokia drive?

means they were pretty confident it wont run on anything other than Nokia (since it would check)
and they put in a Copyright clause (to prevent cracking/hacking?)
and they put in a protection layer (some sort of license check or something ^^)

There is no need to make smoke, if there is no fire.

... Once the latest app/xap is hacked to work on non-nokias it strays into warez territory as you are removing device specific protection ....
