Depends on the circumstances I would guess. If it was entirely accidental then they should as it should be under warranty providing he got the phone from them and not second hand.
Also, has the phone been bootloader unlocked or rooted? Is he running a custom rom?
If so, then he's out of luck...

Sounds more like something that could have been avoided to be fair. Try the "wrestled it from a thief" approach.
That sounds more unavoidable.
Just some phone companies won't replace devices if it was an avoidable issue.
