Wow. I would like to say- regarding this thread, not the legal debate- that the content is very different from its title. This thread has yet to actually reveal ANY of Cotulla's development status other than what has already been seen on YouTube.

As for the legal debate, XDA is a well-known and well-respected forum. Along those lines, moderators have it in their responsibilities to see that nothing illegal happens.

Just hang out and see what happens with WP7 and if you feel that you are being unfair to Microsoft by using a hacked version, then go by a phone with it. This really doesn't need a federal court level debate.

To reiterate.

XDA-"DEVELOPERS".... Not XDA-"LAWSCHOOL"...

Start developing ideas and stop putting down others.

Just a quick read on the HTC site and I found this :-

purchased the HTC Product on which the Software is pre-installed
by or on behalf of HTC, promptly return the HTC Product and the
accompanying Software and items (including documentation and
packaging) to HTC or the HTC authorized distributor from whom you
purchased the HTC Product.
ANY THIRD PARTY SOFTWARE THAT MAY BE PROVIDED WITH THE
SOFTWARE IS INCLUDED FOR USE AT YOUR OPTION. IF YOU CHOOSE
TO USE SUCH THIRD PARTY SOFTWARE, THEN SUCH USE SHALL BE

non-transferable and restricted license to use the Software and any
related documentation (“Documentation”) subject to the following

As I read that, you cannot mess around with the OS on your Device without going against the licence.

I found this site by way of a recomendation by a Microsoft employee. There are two official Microsoft stores in the country (Unless that has recently changed) and one just happens to be in Scottsdale... 20 min away. After purchasing a new phone I had a couple issues with it and took it down to the store. It's a cool store to see anyway. Was an in call volume issue which was odd to both "the phone expert" and myself. He recomened I go to xda.. custom rom's and tweeks that can fix this kind of issue. By no means does that mean Microsoft as a company endorses XDA, but what goes on here is no secret either. Loading custom Roms or tweeking with the phone is not something the vast majority of phone users do. People aren't out there buying an EVO and loading Windows Mobile, I think that would make them jump on it and go after us.. devolopers and moochers such as myself. However, both developers and moochers and all those in between offer a value.. in my example I have always had a Winmo phone and my customers see that and have bought phones like mine for that very reason. I for one like the model of paying for software to drive innovation and support, but I also expect more for what I am paying and out of the box T-mobile software is a joke compared to what Energy and the like cook up. I still paid for Winmo when I bought the phone, so it's not like I am Pirating the software like a $15 copy of Windows 7. I think in a more perfect world I could buy a copy of WP7 for my HD2, but it isn't so go Cotulla! I am not gonna hold on to this HD2 for long, I may not buy an HD7, maybe the next gen, but I will guarantee you this if WP7 is any good at all I will eventually pay for the license a couple times over...iPhone, Andriod, Winmo all have custom ROM's floating around and I have heard of no case where anyone has gone after anyone over it. I just don't think it is in their interest at this time or certainly Apple would have gone after somebody or Microsoft would have gone after XDA a very long time ago. Does anyone know how old this site is? Anyway, maybe my opinion adds to it or maybe not, but rather than legal or not legal How about some info on development status anyone?

Hi there,

attorney at law speaking. The license agreement clearly states: "[...] shall not [...].", but not "[...] is strictly prohibited [...], otherwise the guarentee is null and void [...]".

So, just don't worry...

I don't know why people come here and start posting License agrements and how not to mess with an OS or how not to put something that wasn't put by the manufacturing and what not. Thats the whole point of XDA its a site that is known for doing the inpossible and putting OS on phones that never had it to begin with...

Seriously don't come here if you don't have the same agenda as everybody else... That agenda is to put WP7 on HD2 if you are against it go cry somewhere and stop posting useless crap

eBay wouldn't work because you need to have a past good reputation as a seller to achieve those prices.

What are these local marketplaces you speak of? I've never heard of them...
Good reputation as a seller or buyer. If you have neither perhaps eBay isn't the place for you.

In regards to local marketplaces, perhaps if you tell me where you're located I could help but I'm certainly not going to sit here listing all possible marketplaces around the world. There are millions ranging from craigslist to facebook.

that too, but what are the odds for some parts to be different?
With the current component shortage, the odds are rather big. For instance, when I order capacitators for our LED Line PCB's now, chances are 100% that i will get same spec items from at least 3 different manufacturers at the moment, simply to fullfill our order.
It is that way in the industry now. The 2008 crisis made a lot of factories shut down, and the 2010 restocking surge made demand higher than ever before. So component manufacturers are trying to keep up like mad men.
Apart from that, i haven't even touched the material shortage for manufacturing those components.
All in all it's grab what you can get time.

This is licensing the software (i.e. the OS only) for the device it was embedded on. i.e. doesnt specify that you cant use another OS, merely that you cant copy the OS onto another phone. i.e. its naughty to cook roms from other devices, although since HTC and MS are well aware of cooking and have done very little in terms of action to stop it, you can only guess that they are actually happy that their OS gains more users and attention than the competition (well they would do if they had any business sense)

Guys please, keep it on topic. I will take appropriate action soon.

~~Tito~~
On topic? This whole thread if off-topic! The thread has nothing to do with the title.

Change the title and move it to the general discussion forum.

This thread is not, nor has it ever been, a Cotella development status thread.

because cotulla isn´t really working on it before android nand on hd2 is working completely.
and it will take a lot of time to get all drivers done. this was just the bootloader.

yeah this thread is pretty worthless because Cotulla said he will not release any data and not to ask any questions, so we need to just hang tight, but starting a supposed "cotulla dev status" is misleading and inevitably going to lead to people just ranting.
